Eligibility and Account Requirements To use Assetra's services, you must:

  • Comply with all applicable laws in your jurisdiction and US federal regulations
  • Complete our identity verification process in accordance with KYC/AML requirements
  • Maintain accurate and current account information at all times

You are solely responsible for:

  • Safeguarding your login credentials and enabling two-factor authentication
  • All activities conducted through your account, whether authorized or unauthorized
  • Immediately reporting suspected security breaches or unauthorized access
  • Ensuring your trading activities comply with applicable tax obligations

Platform Services and Availability Assetra provides digital asset trading services including:

  • Cryptocurrency spot trading and order execution
  • Real-time market data and professional trading tools
  • Secure digital asset custody and wallet services
  • Educational resources and customer support

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service due to:

  • Scheduled maintenance and system upgrades
  • Market volatility requiring trading halts
  • Technical issues or third-party service disruptions
  • Regulatory requirements or emergency situations

Trading Risks and User Responsibilities Digital asset trading involves substantial risk, including:

  • Market Risk: Cryptocurrency values can fluctuate dramatically and unpredictably
  • Liquidity Risk: You may not be able to execute trades at desired prices or times
  • Technology Risk: Platform outages or technical issues may affect your ability to trade
  • Regulatory Risk: Changing laws may impact service availability or asset accessibility

By using our platform, you acknowledge these risks and agree that:

  • You are trading with funds you can afford to lose
  • Past performance does not guarantee future results
  • You will conduct your own research before making trading decisions
  • Assetra provides trading tools but not investment advice

Account Actions and Compliance We reserve the right to suspend, restrict, or terminate accounts when:

  • Suspicious activity or potential fraud is detected
  • Anti-money laundering or sanctions violations are suspected
  • Terms of Service violations occur
  • Regulatory compliance requires such action
  • Court orders or legal processes mandate account restrictions

Before taking such actions, we will provide notice when legally permissible and offer opportunity to resolve issues where appropriate.

Fee Structure and Transaction Costs All trading fees, withdrawal charges, and service costs are clearly displayed on our platform before transaction confirmation. Fees may include:

  • Trading commissions based on transaction volume
  • Network fees for blockchain transactions (passed through at cost)
  • Currency conversion charges for fiat transactions
  • Premium service fees for advanced features

We provide 30 days' notice before implementing fee changes that affect existing users.

Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Assetra's total liability to you shall not exceed the fees you paid in the 12 months preceding the claim
  • We are not liable for losses resulting from market volatility, your trading decisions, or external factors beyond our control
  • We disclaim liability for indirect, consequential, or punitive damages
  • This limitation applies regardless of the legal theory underlying your claim

Intellectual Property and Platform Use The Assetra platform, including its software, trademarks, and content, is protected by intellectual property laws. You may:

  • Use our platform for legitimate trading purposes
  • Access educational materials for personal use
  • Share basic platform information with proper attribution

You may not:

  • Reverse engineer, copy, or distribute our proprietary software
  • Use automated systems to manipulate markets or circumvent security
  • Reproduce our content without written permission
  • Interfere with platform operations or other users' access

Data Protection and Privacy Your personal information is processed according to our Privacy Policy, which forms part of these Terms. We implement institutional-grade security measures but cannot guarantee absolute security against all threats.

Dispute Resolution Step 1: Direct Resolution Contact our support team at support@assetra.xyz to resolve issues informally. We commit to responding within 48 hours and resolving most matters within 10 business days.

Step 2: Formal Complaint Process If direct resolution fails, submit a formal complaint through our platform. We will investigate and provide a written response within 30 days.

Step 3: Legal Proceedings Any unresolved disputes shall be governed by Delaware state law and resolved in Delaware state or federal courts. Both parties waive rights to jury trial and class action participation.

Modifications and Updates We may update these Terms to reflect:

  • Changes in services or business operations
  • New regulatory requirements
  • Enhanced security measures
  • User feedback and platform improvements

Material changes will be communicated via email and platform notifications at least 30 days before becoming effective. Continued use of our services constitutes acceptance of updated Terms.

Termination Either party may terminate this agreement:

  • By you: Close your account through platform settings after withdrawing all funds
  • By us: With 30 days' notice for convenience, or immediately for cause
  • Automatic: If your account remains inactive for 24 months with zero balance

Upon termination, you remain liable for all outstanding obligations, and relevant provisions survive to protect both parties' interests.

Regulatory Compliance Assetra operates under Delaware corporate law and complies with applicable US federal regulations including:

  • Bank Secrecy Act and anti-money laundering requirements
  • FinCEN regulations for money service businesses
  • Securities laws where applicable
  • State money transmitter licenses as required
